Terms of Service

Engagematic ("we", "us") operates engagematic.app, a tool that helps creators understand their audience and preview how a draft post might perform, using AI personas built from publicly available Instagram engagement. Engagematic is operated by the Engagematic team (legal entity details available on request at support@engagematic.app).

Engagematic is not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc.

You need an account to use Engagematic. You must be at least 16 years old, provide accurate information, and keep your password safe — activity on your account is your responsibility. You may only analyze Instagram profiles that you own or manage, or that you are authorized to work with (for example, as an agency acting for a client).

Our simulations, scores, predicted comments, and recommendations are estimates generated by AI. They are based on public engagement patterns and can be wrong. We show our predictions next to your real results precisely so you can judge their accuracy — but we do not guarantee any particular engagement, follower growth, revenue, or brand-deal outcome.

"AI twins" are fictional AI personas inspired by aggregate public behavior. They are not the real people, do not speak for them, and their simulated comments are not statements by any real person.

You agree not to:

• analyze profiles you have no right to work with;
• use Engagematic to harass, impersonate, or build profiles of individuals for purposes unrelated to your own content planning;
• scrape, resell, or redistribute data obtained through Engagematic;
• probe, overload, or interfere with the service, or bypass plan limits and rate limits;
• use the service in violation of any law or third-party terms.

We may suspend or terminate accounts that break these rules.

Engagematic offers a Free plan and paid subscriptions (currently Creator and Agency). Payments are processed by Paddle, our merchant of record — your purchase is also subject to Paddle's checkout terms. Subscriptions renew monthly until cancelled. You can cancel anytime from the Billing page; your plan stays active until the end of the paid period. Plan changes are prorated. Refunds are handled per our Refund Policy.

We may change prices or plan limits; if we do, we'll notify you before your next renewal.

Draft posts, captions, and images you upload stay yours. You give us a limited license to process them (including sending them to our AI provider) solely to provide the service — for example, to run a simulation you requested. We don't publish your drafts anywhere.

The Engagematic software, design, models, and generated reports are our intellectual property or that of our licensors. Public Instagram data remains subject to Instagram's own terms; we provide analysis of it, not ownership over it.

Engagematic is provided "as is". To the maximum extent permitted by law, we disclaim all warranties and are not liable for indirect, incidental, or consequential damages — including lost profits, lost brand deals, or follower changes. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose (or $50 if you're on the Free plan).

You can delete your account anytime by emailing support@engagematic.app. We may suspend or terminate the service for breach of these terms, with notice where practical. Sections that by their nature should survive (liability, IP, disputes) survive termination.

We may update these terms; material changes will be announced in the app or by email, and continued use after that means you accept them. Questions? Email support@engagematic.app.
